Welcome to Sansglu! These Terms of Service (“Terms”) govern your use of our website at https://www.sansglu.com (the “Site”), the Sansglu mobile application (the “Mobile App”), and all related services, features, content, communications, and functionalities provided by Sansglu Inc. (“Sansglu,” “we,” “us” or “our”) (collectively, the “Services”). PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.
By accessing or using our Services in any manner, or by clicking “I Accept” (if applicable), you agree to be bound by these Terms. If you do not agree to these Terms or any modifications made by us in the future, please do not use the Services.
Platform Services
Sansglu is a restaurant discovery platform specializing in gluten-free dining options. Our Services provide users with a map-based interface displaying restaurants with information regarding gluten-free and celiac-safe dining, including menus, safety protocols, user reviews, and location-based searching. Please note that while we strive for accuracy, the information displayed is provided for your convenience only and is not a substitute for confirmed restaurant policies or professional dietary advice.
Acknowledgement and Disclaimers
a. Although we work diligently to ensure that all restaurant listings, menus, and safety details are reliable and up to date, Sansglu does not guarantee the accuracy, completeness, or timeliness of any information provided through the Services.
b. The information provided by Sansglu is for informational purposes only and should not be considered as professional dietary, medical, or legal advice. Always verify directly with the restaurant regarding safety protocols and gluten-free offerings.
c. Your use of the Services is at your sole risk. Sansglu, its affiliates, officers, directors, employees, or agents are not responsible for any harm, loss, or inconvenience arising from reliance on any information provided.
General Use and Consent
Subject to these Terms, you are responsible for your use of the Services and for any Content (defined below) that you post, access, or transmit via the Services. Your use of the Services is governed by these Terms and all applicable laws. If you do not agree with these Terms, do not use our Services.
Privacy
Your privacy is important to us. Your access to and use of our Services is subject to our Privacy Policy, which is incorporated herein by reference. By using our Services, you consent to our Privacy Policy.
Accounts
Some features of our Services require you to create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.
Eligibility
By using the Services, you represent and warrant that you are at least 18 years old (or the applicable age of majority in your jurisdiction) and are legally capable of entering into binding agreements. If you are providing access to the Services to other individuals (each, an “Authorized User”), you are solely responsible for all actions taken by such Authorized Users and must ensure that they abide by these Terms.
User Content and Feedback
a. Content. You may contribute content to our Services, including reviews, ratings, photos, and comments (collectively, “User Content”). By submitting User Content, you grant Sansglu a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable, and transferable license to use, display, adapt, distribute, and reproduce that content in any media or format.
b. You represent and warrant that you own or otherwise have the right to grant the rights in your User Content and that your content does not infringe the intellectual property rights or violate the privacy or other rights of any third party.
c. Feedback. Any feedback you provide regarding improvements or new features may be used by us without compensation or attribution to you.
Interactions With Other Users
You are solely responsible for your interactions with other users. While we strive to foster a safe and respectful community, Sansglu does not screen or verify the identities of users and is not responsible for the conduct of any user. You agree to exercise caution and report any behavior that violates these Terms or that you believe is harmful.
Compliance With Laws
You shall use the Services only for lawful purposes and in compliance with all applicable federal, state, local, and international laws and regulations. You agree not to use the Services for any illegal or unauthorized purpose.
Fees and Payment
a. In general, access to the basic features of Sansglu is free. We offer premium features under the Sansglu Pro subscription, which include expanded geographic access, complete menu unlock, organization of favorites and collections, dedicated gluten-free facility filtering, in-app search for food items, and dark mode.
b. Pricing for Sansglu Pro is $9.99 per month or $79.99 per year (a 33% annual savings). Free trial periods are available (one week for monthly plans and two weeks for annual plans). All fees and charges are non-refundable except as provided by law.
c. Sansglu reserves the right to change its pricing and fees at any time. We will inform you of any material changes to the fees via the email address associated with your account or through the Services.
Subscriptions
a. If you subscribe to Sansglu Pro via our Mobile App or an external platform (such as the Apple App Store or Google Play), your subscription will automatically renew until you cancel it in accordance with the instructions provided at the time of purchase.
b. To cancel a subscription, you must follow the specific cancellation procedures provided by your respective external platform. If you initiate a chargeback or reverse payment, we may immediately cancel or downgrade your account.
License to the Services
Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial use. This license does not include any resale or commercial use of the Services or their contents.
Restrictions on Use
You agree not to:
- Reproduce, duplicate, copy, sell, trade, resell, or exploit any portion of the Services without our express written consent.
- Reverse engineer, decompile, disassemble, or create derivative works of any part of the Services.
- Circumvent, disable, or otherwise interfere with security-related features of the Services.
- Use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party's use of the Services.
- Modify, rent, lease, loan, or sublicense the Services or any of its parts.
- Use any automated means (such as robots or data mining) to access or collect data from the Services without our prior written permission.
License Grant to Your Content
Except for any non-public personal information that you provide, by submitting or posting any content to our Services, you grant Sansglu a perpetual, worldwide, royalty-free, fully transferable, sub-licensable license to use, store, display, reproduce, and distribute your content in connection with the Services.
Suspension and Termination
Sansglu reserves the right to suspend, restrict, or terminate your access to the Services at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. In case of termination, you are responsible for any outstanding fees, and access to your account and data may be disabled. Certain provisions of these Terms, such as disclaimers, indemnifications, limitations of liability, and intellectual property rights, will survive termination.
Third-Party Links and Content
The Services may contain links to third-party websites or resources. Such links are provided solely for your convenience, and Sansglu is not responsible for the content, products, services, or privacy practices of any third parties. Your interactions with these third-party sites are solely between you and the third party.
Beta Services
From time to time, Sansglu may offer access to beta or experimental features (“Beta Services”). Beta Services are provided “as is” and are subject to change or discontinuation without notice. Your feedback on Beta Services is appreciated and you agree that any feedback may be used by Sansglu without any obligation of compensation or confidentiality.
Assumption of Risks; Release
a. You acknowledge that you are solely responsible for verifying the gluten-free safety and dining suitability of any restaurant listed on the Services.
b. You assume all risks associated with your use of the Services—including, but not limited to, inaccuracies in restaurant information, menu details, or safety protocols—and agree that Sansglu is not liable for any damages or losses arising from such use.
c. By using our Services, you release and hold harmless Sansglu and its affiliates, directors, officers, employees, and agents from any and all claims, liabilities, damages, and expenses arising out of or in connection with your use of the Services.
Indemnification
You agree to indemnify, defend, and hold harmless Sansglu, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services; your violation of these Terms; or your infringement of any rights of another.
Limitations of Liability and Disclaimers
a. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
b. NEITHER SANSGLU NOR ANY OF ITS AFFILIATES SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
c. OUR AGGREGATE LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
Term and Termination
a. These Terms will commence upon your acceptance and continue until terminated by either party.
b. Sansglu may terminate or suspend your access to the Services at any time, with or without cause and without liability.
c. Upon termination, all rights granted to you herein will cease immediately, and you agree to discontinue all use of the Services. Termination will not affect any obligation that accrued prior to termination, including, without limitation, payment of fees.
Separate Agreements
Additional agreements or policies that reference these Terms (or that are posted on the Services) are incorporated herein by reference. In case of any conflict between these Terms and any other agreement, the other agreement will control only with respect to that specific provision or subject matter, unless otherwise stated.
Notices
We may provide you with notices via the Services, by email, or by other reasonable means. Notices shall be deemed given when delivered by email or posted on the Services. Please keep your contact information updated to receive such notices.
Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services (except for disputes regarding intellectual property rights), the parties agree to first attempt informal resolution with our support team. If unresolved, you agree that the dispute will be resolved exclusively through binding arbitration administered by the American Arbitration Association (or a similar organization) in accordance with its rules. The arbitration shall be conducted by a single arbitrator and held in the location determined by Sansglu. BY AGREEING TO ARBITRATION, YOU WAIVE YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
Governing Law
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law principles.
Interpretation
The section headers in these Terms are provided for convenience only and do not affect the interpretation of the Terms. Any ambiguities or inconsistencies shall be resolved in accordance with applicable law.
Entire Agreement
These Terms, together with any additional terms incorporated by reference, constitute the entire agreement between you and Sansglu regarding your use of the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
Amendments and Waivers
Sansglu reserves the right to modify or amend these Terms at any time by posting the revised Terms on our Site. Your continued use of the Services following any such changes constitutes your acceptance of the new Terms. No waiver of any provision of these Terms shall be effective unless in writing.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
Inurement
These Terms shall inure to the benefit of and bind the parties and their respective successors, assigns, and legal representatives.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Sansglu may assign its rights or obligations under these Terms without notice to you.
